Reporting to the Senior Legal Counsel (Legal Advisory) (“SLC”), the Legal Counsel (Legal Advisory) (“LC”) is responsible for the provision of effective advice, services, and representation for legal and regulatory matters to various divisions within CIMA ensuring their effective and efficient operations. LC will also be responsible for advising the Authority’s general operations and assisting with various research and other ad hoc projects.
RESPONSIBILITIES:
The successful candidate will:
• Provide sound advice and legal opinions to various divisions within CIMA on legal and enforcement matters and recommends appropriate legal response or action, which best serves to meet CIMA’s goals and objectives;
• Draft requirements and directives under the Monetary Authority Law, as well as relevant circulars and memoranda of understanding and advises Management on contraventions of any of the Acts, regulations or directives;
• Provide training to CIMA staff on legal and regulatory developments and participates in multidisciplinary working groups;
• Research, analyse and propose changes to the legislative framework to ensure CIMA is operating effectively, appropriately in light of current circumstances, and consistent with international standards and best practice;
• Research and draft legal opinions on legal problems and issues arising from specific cases and on any CIMA related matters as requested by authorised CIMA management staff;
• Review and comment on papers and policies prepared by CIMA staff as requested;
• Review and advise on all correspondence regarding requests for assistance by and to overseas regulatory authorities;
• Build/maintain positive, cooperative relationships with various government departments and ministries, other statutory authorities, the courts in Cayman, and overseas regulatory authorities; and
• Responds promptly to requests for assistance and information from members of the legal and financial community and the public.
REQUIREMENTS:
The minimum qualifications required to successfully perform the job are as follows:
• A solicitor, barrister or attorney-at-law qualified to practice in an English-speaking Commonwealth jurisdiction;
• Five (5) years of post-qualification experience in litigation, civil, corporate commercial or administrative law;
• Experience in financial regulation and international financial legal matters would be advantageous;
• Experience in handling regulatory enforcement and administrative fine matters;
• Experience of driving legal matters forward efficiently and effectively, delivering to a high standard, even under pressure;
• Knowledge and understanding of relevant legislation, regulations and procedures governing CIMA and working knowledge of the Cayman Islands court system;
• Excellent advocacy and presentation skills; and
• Strong research, analytical and investigatory skills to quickly analyse complex factual situations to understand key risk issues across financial services supervisory and operational areas in CIMA.
